IMPORTANT DATES UNDER THE RULES

On or Before March 1, 2007

A. All wells must either:

1. Be equipped with a totalizing flow meter; or

2. Be equipped with an alternate measurement method granted under a variance to the Rules; or

3. Be declared inactive under Rule 7.

B. All well owners who install totalizing flow meters must file a written notice of compliance with the Division Engineer.

C. All well owners who obtain a variance from installation of a totalizing flow meter must file a written notice of compliance with the terms and conditions of the approved variance.

D. All totalizing flow meters must be certified to be in accurate working condition by a Qualified Well Tester within one year from its installation or March 1, 2008, whichever is earlier.

Data Reporting Deadlines

December 1, 2006: Optional date for submitting to the Division engineer records for groundwater withdrawal in 2006.

December 1, 2007: Optional date for submitting to the Division Engineer records of ground water withdrawals in 2006 and/or 2007.

December 1, 2008: Date by which data for all groundwater withdrawals from at least March 1, 2007 must be reported to the Division Engineer. Groundwater withdrawal data reported by December 1, 2006 or 2007 need not be reported again on December 1, 2008.

Totalizing Flow Meter Accuracy Verification

Every four years after meter verification - a new totalizing flow meter accuracy verification must be submitted every four years after the date of the last submission of a verification for that flow meter.

For purposes of initial compliance with the Rules a totalizing Flow Meter Verification must be submitted within one year of the installation of the meter, or March 1, 2008, whichever is earlier.

Power Coefficient Conversion Measurement Method: The Power Coefficient Conversion must be re-rated every two years unless more frequent rerating is required by the State Engineer.

Power Account Number Change

If the number of your account from your power supplier changes you must notify the Division engineer of the new account number within 45 days.

Penalties for Noncompliance

Failure to comply with any of these rules may subject the Well owner and/or user to court proceedings and the state’s costs, including reasonable attorney’s fees, associated with enforcement of these rules pursuant to section 37-92-503, C.R.S. Prior to filing any court action, the Division 3 Engineer shall notify the Well owner and or user (or both if known by records maintained by the Division 3 Engineer) of the violation in writing by Certified Mail and shall advise the Well owner and/or user of the date by which the violation must be corrected to avoid court proceedings, which date shall be at least ten calendar days following the date of receipt of the notice to the Well owner and/or user or personal service of the notice on the Well owner and/or user.
